1. Acceptance of Terms

By accessing or using the WhereIsMyEvent platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

WhereIsMyEvent is a software-as-a-service (SaaS) platform designed for organizations that manage events. The Service provides:

• A dashboard for creating, managing and publishing events;
• An embeddable interactive map widget that can be placed on third-party websites to display your events;
• Team collaboration features with role-based access;
• Widget analytics (views, pin clicks, calendar adds);
• Public event pages with sharing and calendar integration.

3. Account Registration & Responsibilities

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activities that occur under your account;
• Notifying us promptly of any unauthorized use of your account.

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account.

4. Subscription Plans & Billing

WhereIsMyEvent offers several subscription tiers (Starter, Pro, Business, Enterprise). Key billing terms:

• Free trial: New accounts may be eligible for a 14-day free trial of paid features. No payment information is required during the trial period.
• Payment processing: All payments are processed securely through Stripe. WhereIsMyEvent does not store your credit card information.
• Auto-renewal: Paid subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
• Refunds: Subscription fees are non-refundable, except as required by applicable law.
• Plan changes: You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Publish fraudulent, misleading or illegal event listings;
• Distribute malware, spam or any harmful content;
• Attempt to gain unauthorized access to the Service or its infrastructure;
• Interfere with or disrupt the Service or its servers;
• Scrape, crawl or harvest data from the Service without authorization;
• Use the Service to compete directly with WhereIsMyEvent.

We reserve the right to suspend or terminate accounts that violate this policy.

6. Intellectual Property

The Service, including its design, code, features, documentation and branding, is the intellectual property of WhereIsMyEvent. You may not copy, modify, distribute or reverse-engineer any part of the Service without our prior written consent.

7. Data & Content Ownership

You retain full ownership of all content and data you submit to the Service, including event information, images and organization details. By using the Service, you grant WhereIsMyEvent a limited, non-exclusive license to host, display and transmit your content solely for the purpose of operating the Service.

You may export or delete your data at any time, subject to any applicable retention requirements.

8. Widget Embed License

WhereIsMyEvent grants you a non-exclusive, revocable license to embed the map widget on your own websites or websites you are authorized to manage. The widget must be used in accordance with these Terms and may not be modified, reverse-engineered or used in a manner that misrepresents the source of the content.

9. Service Availability & Disclaimers

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service is provided on a "best-effort" basis. We may perform maintenance, updates or changes that temporarily affect availability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Limitation of Liability

To the maximum extent permitted by applicable law, WhereIsMyEvent shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, business opportunities or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid to WhereIsMyEvent in the twelve (12) months preceding the claim.

11. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your access to the Service if:

• You breach these Terms;
• Your account has been inactive for an extended period;
• We are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which WhereIsMyEvent operates. Any disputes arising from these Terms shall be resolved through good-faith negotiation and, if necessary, through the competent courts of that jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
